When a loved one passes away, many families are left to deal with property, benefits and other ownership issues. In an effort to offer the families we serve some guidance, we have complied the following list of local resources. We hope that this information will assist you in the transfer of property and the determination of benefits.
Under Florida law, there are a few basic rules for determining who owns the property of a recently deceased loved one. If the property was owned jointly by spouses or by "joint tenants with rights of survivorship" between two non-married individuals, then that property belongs to the surving spouse of tenant. If the property was in the name of the deceased alone, then it will be distributed under the terms of the deceased's will. If there is no will, the property will be distributed under the law as defined by Florida Statues.
